Protection of the Right to Life under Epidemic Prevention and Control and Improvement Path

Abstract

Since 2020, we have been inconvenienced by the COVID-19 pandemic, a scourge that has engulfed all of humanity. This sudden public health event is like a demon mirror, which "shines" a lot of problems at the social level, and different countries have different ways and attitudes to deal with them."Herd immunity", "freedom above" and other measures of Western countries, we do not confirm or deny. "True freedom is the freedom of self-discipline, not the freedom of indulgence." This has been demonstrated in China's fight against COVID-19. The earth is the common earth of all mankind, not the earth of some people. In the face of such a disaster, people's right to life should be above all rights and interests. "Putting people first" has always been the commitment of our country, and our Party has been putting into practice. Every infected person has the equal right to receive treatment, and the state finances the treatment and prevention costs of the epidemic, making every effort to save the lives of patients. However, before such a public health emergency, China's prevention and control policy also had many shortcomings, such as the constitutional status of the right to life was not clearly established; There is no uniform standard for the scope of derogation when the right to life is prioritized over other human rights; The phenomenon of "one size fits all" in many places leads to a conflict between law and morality; Insufficient balance between the right to life and the fundamental rights of others; The shortage of public medical supplies, the slow development of specific drugs and vaccines, etc. We hope that in the midst of epidemic prevention and control, we will continue to improve relevant legislation and safeguard measures, and include the priority protection of the right to life in the Constitution or constitutional amendments. (I) Uniform standard requirements for derogations from other human rights; The vulnerable groups' right to life should have special protection strategies; Measures that abuse the right to life should be rejected. Meanwhile, the public medical security system should be improved to protect citizens' right to life during the epidemic.
