Identification of the Legal Relationship Between the Subjects of Personal Help Crowdfunding

Abstract
With the rapid development of the Internet and the popularization of social media, personal help-seeking crowdfunding is becoming increasingly common in China. However, it is important to note that personal help-seeking crowdfunding is not currently covered by charity-related legislation, such as the Charity Law of the People's Republic of China. This has led to a lack of legal regulation of personal help-seeking crowdfunding, which reflects the weakness of the theoretical basis of the legal system. There are several different views on the legal relationship between the helper, the donor, and the crowdfunding platform in individual crowdfunding. The mainstream views include the intermediary contract, the fiduciary relationship, and the third-party contract of interest. In this paper, I aim to clarify the legal concepts and relationships associated with personal help-seeking crowdfunding by reviewing different perspectives. By doing so, I hope to address the existing theoretical gaps and provide a theoretical foundation for future regulation of this practice.
